{"id":18426,"date":"2026-04-10T19:53:03","date_gmt":"2026-04-10T18:53:03","guid":{"rendered":"https:\/\/inernews.online\/?p=18426"},"modified":"2026-04-10T19:53:03","modified_gmt":"2026-04-10T18:53:03","slug":"us-federal-court-hears-new-case-against-trump-tariffs-business-and-economy-news","status":"publish","type":"post","link":"https:\/\/inernews.online\/?p=18426","title":{"rendered":"US federal court hears new case against Trump tariffs | Business and Economy News"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"\">\n<p class=\"article__subhead\"><em>The case is to overturn the temporary tariffs that Trump imposed after the Supreme Court struck down his earlier ones.<\/em><\/p>\n<\/div>\n<div>\n<div class=\"article-dates\">\n<p><span class=\"screen-reader-text\">Published On 10 Apr 2026<\/span><span aria-hidden=\"true\">10 Apr 2026<\/span><\/p>\n<\/div>\n<\/div>\n<div aria-live=\"polite\" aria-atomic=\"true\">\n<p>The centrepiece of United States President Donald Trump\u2019s economic policy \u2014 sweeping taxes on global imports \u2014 is under legal assault again.<\/p>\n<p>A three-judge panel of the US Court of International Trade, a specialised court in New York, is hearing oral arguments on Friday in an attempt to overturn the temporary tariffs Trump turned to after the Supreme Court in February struck down his preferred choice \u2014 even bigger, even more sweeping tariffs.<\/p>\n<section class=\"more-on\">\n<h2 class=\"more-on__heading\">Recommended Stories<!-- --> <\/h2>\n<p><span class=\"screen-reader-text\">list of 4 items<\/span><span class=\"screen-reader-text\">end of list<\/span><\/section>\n<p>Several US states and small businesses have said the\u00a010 percent global import tax that Trump imposed in February sidesteps the Supreme Court ruling that invalidated most of his previous tariffs.<\/p>\n<p>A group of 24 mostly Democratic-led\u00a0states\u00a0and two\u00a0small businesses\u00a0sued the Trump administration to stop the new tariffs, which went into effect on February 24.<\/p>\n<p>Oregon\u2019s lawyer Brian Marshall told the judges they should block the 10 percent tariffs rather than let them expire on the normal 150-day timeline, to keep Trump from invoking a variety of laws to keep them indefinitely.<\/p>\n<p>\u201c[If] we have a successive series where there\u2019s always tariffs in place, that\u2019s a problem,\u201d Marshall said.<\/p>\n<p>Marshall also said the tariffs were based on archaic authority that was meant to protect the US dollar from sudden depreciation in the 1970s, when dollars could be exchanged for gold reserves held in Fort Knox.<\/p>\n<p>He said that authority was meant to resolve significant \u201cbalance-of-payments deficits\u201d, and Trump cannot repurpose it to address routine trade deficits.<\/p>\n<h2 id=\"tariffs-a-central-pillar\">Tariffs, a central pillar<\/h2>\n<p>Trump has made tariffs a central pillar of his foreign policy in his second term, claiming sweeping authority to issue tariffs without input from Congress.<\/p>\n<p>The administration has said that global tariffs are a legal and appropriate response to a persistent trade deficit caused by the fact that the US imports more goods than it exports.<\/p>\n<p>\u201cPresident Trump is lawfully using the executive powers granted to him by Congress to address our country\u2019s balance of payments crisis,\u201d White House spokesperson Kush Desai said.<\/p>\n<p>Trump imposed the new tariffs under Section 122 of the Trade Act of 1974, which authorises duties of up to 15 percent for up to 150 days on imports during \u201clarge and serious United States balance-of-payments deficits\u201d or to prevent imminent depreciation of the dollar.<\/p>\n<p>The states and small businesses argue that the Trade Act\u2019s tariff authority is meant only to address short-term monetary emergencies, and routine trade deficits do not match the economic definition of \u201cbalance-of-payments\u00a0deficits.\u201d<\/p>\n<p>Trump announced the new tariffs on February 20, the same day the Supreme Court handed him a stinging defeat when \u2060it struck down a broad swath of tariffs he had imposed under the International Emergency Economic Powers Act (IEEPA), ruling that the law did not give him the power he claimed.<\/p>\n<p>No US president before Trump had used the IEEPA or Section 122 to impose tariffs.
