And in late October, he stood over Palestinian prisoners forced to lie face-down on the floor as he called for the death penalty to be introduced for those he termed Palestinian \u201cterrorists\u201d.<\/p>\n<section class=\"more-on\">\n<h2 class=\"more-on__heading\">Recommended Stories<!-- --> <\/h2>\n<p><span class=\"screen-reader-text\">list of 3 items<\/span><span class=\"screen-reader-text\">end of list<\/span><\/section>\n<p>Ben-Gvir may soon get his wish.<\/p>\n<p>In early November, the Israeli parliament passed the first reading of a bill that would introduce the death penalty for those convicted of killing Israelis if they had \u201cracist\u201d motives or were doing it \u201cwith the aim of harming Israel\u201d. The bill clearly targets Palestinians, even as Israelis carry out deadly attacks against Palestinians in the occupied West Bank, and Israel continues its killing of Palestinians in Gaza.<\/p>\n<p>The reaction has been stark among Palestinians. What they hear is not just another legislative measure, but a signal that Israel is planning to formalise a system of lethal punishment.<\/p>\n<p>\u201cThis law practically aims to execute prisoners simply for their struggle for their people\u2019s freedom and their right to self-determination,\u201d said Farid al-Atrash, the director of the Independent Commission for Human Rights in the occupied West Bank.<\/p>\n<p>Alarm is widespread among Palestinian lawyers and activists. They claim that the law fundamentally undermines judicial safeguards, and warn that it seeks to erase the status of Palestinian detainees as protected under international law.<\/p>\n<h2 id=\"remove-protections\">Remove protections<\/h2>\n<p>Under the draft legislation, Israeli courts \u2013 both civil and military \u2013 would gain expanded power to impose mandatory death sentences on Palestinians convicted of killing Israelis, when such acts are deemed to have been motivated by nationalistic, racist or hate-based reasons, or intended to harm the State of Israel or its people.<\/p>\n<p>It would also remove the authority for a government or president to pardon anyone who has been sentenced to death for those crimes, and it does not require a panel of judges in a given case to reach a unanimous decision on the sentence.<\/p>\n<p>Palestinian advocates warn that the framework eliminates the safeguards that previously existed for Palestinian defendants.<\/p>\n<p>Al-Atrash placed the proposed law in stark contrast to the treatment of Israelis in cases dealing with violence against Palestinians, in which they are often acquitted.<\/p>\n<h2 id=\"international-humanitarian-law\">International humanitarian law<\/h2>\n<p>Critics say that the move to legalise the death penalty is part of a broader effort to strip Palestinians of their protections under international humanitarian law as an occupied people with a right to resistance.<\/p>\n<p>\u201cThe Israeli Knesset [parliament], dominated by the far-right, is working to turn killing into official legislation,\u201d said Hassan Breijieh, who is the head of the Bethlehem office of the Wall and Settlements Resistance Commission. \u201c[The proposed law] is an attempt to erase international recognition of the Palestinian fighter \u2026 and turn him into a criminal defendant.\u201d<\/p>\n<figure id=\"attachment_4138265\" aria-describedby=\"caption-attachment-4138265\" style=\"width:770px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" data-recalc-dims=\"1\" loading=\"lazy\" class=\"size-arc-image-770 wp-image-4138265\" src=\"https:\/\/www.aljazeera.com\/wp-content\/uploads\/2025\/11\/9H6B5820-1764365186.jpg?w=770&amp;resize=770%2C513&amp;quality=80\" alt=\"Farid al-Atrash stands in front of a banner\" fetchpriority=\"low\"\/><figcaption id=\"caption-attachment-4138265\" class=\"wp-caption-text\">Farid al-Atrash, director of the Independent Commission for Human Rights, says the proposed law would punish Palestinians for struggling for their freedom [Mosab Shawer\/Al Jazeera]<\/figcaption><\/figure>\n<p>Amjad al-Najjar, of the Palestinian Prisoners\u2019 Club, agreed that the proposed law was an effort to take away the rights of the Palestinian people.<\/p>\n<p>\u201cIt is a double crime. It is a racist law targeting Palestinians, specifically, and also a clear violation of international law,\u201d said al-Najjar.<\/p>\n<p>Saeed al-Awiwi, a Palestinian lawyer and former judge, framed the proposed law as the latest clampdown on Palestinian legal rights.<\/p>\n<p>Al-Awiwi noted that even previously permissible access to detainees in Israeli prisons has been revoked, leaving many prisoners with no meaningful legal representation, especially inside military courts.<\/p>\n<p>He argued that, even before the bill, many Palestinians died inside prisons without trial, sentencing, or any due process. If the death penalty becomes codified, the actions that caused those deaths \u2013 torture, medical neglect, and arbitrary detention \u2013 will gain official standing.<\/p>\n<p>\u201cThe move towards legal execution legalises actions already practised by the [Israeli] occupation, but without accountability,\u201d al-Awiwi said.<\/p>\n<h2 id=\"prosecuting-freedom\">\u2018Prosecuting freedom\u2019<\/h2>\n<p>For defenders of the Israeli law, it is necessary.<\/p>\n<p>Israel\u2019s National Security Committee said that \u201cits purpose is to cut off terrorism at its root and create a heavy deterrent\u201d.<\/p>\n<p>But human rights organisations such as Amnesty International have condemned the bill as a form of institutionalised discrimination targeting Palestinians.<\/p>\n<p>Under the Geneva Conventions and international humanitarian law, the execution of prisoners of war or protected persons \u2013 including those under occupation \u2013 is prohibited.
